Website and purchase terms

These terms apply to purchases of digital resources from The Workplace Kit, ABN 85 534 053 138. Contact info@theworkplacekit.com.au with purchase questions. Read these terms, the Digital Product Refund Policy and the Toolkit Usage Licence before ordering. Our Privacy Policy explains information handling.

Our products

We sell digital HR templates, guides and trackers designed for Australian business use. The product page identifies the documents included, file formats and any stated compatibility requirements. No physical goods are supplied unless expressly stated.

Our resources provide general HR tools and guidance. They are not personalised HR or legal advice, a compliance certification or a guarantee of a particular workplace outcome. Customers must adapt them to their circumstances and verify relevant current requirements. Seek qualified advice for sensitive, high-risk or legally regulated matters, including specific disputes or significant employee decisions. We do not provide award, pay or termination calculations through these products.

The free HR Health Check is an indicative assessment based on your responses. Its score and recommendations do not verify your workplace practices or establish legal compliance.

Orders and payment

Prices are shown in Australian dollars unless stated otherwise. The final checkout shows the amount payable and any applicable taxes or charges before you place the order. Provide accurate purchaser and delivery-email details and ensure you are authorised to purchase for the nominated business.

An automated order receipt confirms receipt of your order. Your purchase is accepted when payment has been approved and the digital files or access to them are supplied. If we cannot supply an order, we will explain the issue and refund payments for any product not supplied. We will not impose an increased price on an existing order without your agreement.

Digital delivery and compatibility

Products are supplied as digital downloads, typically a ZIP file containing editable Word documents and, where applicable, Excel trackers. Delivery details are provided through the order confirmation or download process once payment is approved. Contact us if the download is missing or cannot be accessed.

You will need internet access, the ability to open ZIP files and software compatible with the formats listed on the product page. Layout, formulas or other features may differ in alternative software. We do not guarantee identical operation in every application. This does not exclude any guarantee about fitness for a disclosed purpose or compliance with our description.

Save a secure copy of your files. Contact us for assistance if a download link becomes unavailable. Any stated download limits or access periods must be disclosed before purchase; these terms do not introduce a hidden expiry.

Licence and product updates

Your purchase grants the internal-business licence described in the Toolkit Usage Licence. Copyright in our original templates and guides remains with us or the relevant rights holder. You may adapt and rebrand documents for the licensed business’s internal use within that licence.

The purchase includes the version supplied at purchase. Future editions, ongoing legal monitoring and personalised implementation support are not included unless expressly advertised. This does not remove our obligation to remedy a product that fails to meet applicable consumer guarantees.

Refunds and customer rights

Our Digital Product Refund Policy explains change-of-mind requests and remedies for problems. Nothing in these terms, our disclaimers or the licence excludes, restricts or modifies a consumer guarantee, remedy or other right that cannot lawfully be excluded. Business customers may also have these rights. We remain responsible for obligations imposed by applicable law.

Responsible website use

Do not interfere with website security, attempt unauthorised access, upload malicious code or distribute our resources contrary to the licence. If misuse occurs, we may take reasonable steps proportionate to the issue. Any action affecting a paid licence will follow the notice and remedy provisions in the licence, subject to applicable law.

Changes and disputes

The terms presented at purchase apply to that purchase. Updates apply to future purchases and do not retrospectively reduce existing rights. If a dispute arises, contact us with the relevant order details so we can try to resolve it. You retain the right to approach a regulator, tribunal or court.

These terms are governed by NSW law and applicable Commonwealth law, without taking away mandatory protections or access to a forum available to you under applicable law. If a provision cannot lawfully be enforced, the remaining provisions continue to apply to the extent permitted.
